ON
THE IMPORT OF COMMERCIAL AND FISHING SHIPS IN NEW AND NOT NEW CONDITION
THE PRESIDENT OF THE REPUBLIC OF INDONESIA
Considering :
- a. that in the framework of national economic reforms and restructuring to boost the not new of efficiency of domestic industries and the smoothness of the flow of goods, it is deemed necessary to exempt the import of merchant and fishing ships in new and not new condition from non-tariff barriers;
- b. that in connection with the said matter, it is deemed necessary to stipulate a Presidential Decree on the import of merchant and fishing ships in new and not new condition.
In view of:
- 1. Article 4 paragraph (1) of the Constitution of 1945;
- 2. The trade Ordinance of 1934 (Statute Book of 1938 No. 86) as already amended and supplemented;
- 3. Law No. 7/1994 on the ratification of the agreement establishing the World Trade Organization (Statute Book 1994 No. 57, Supplement to Statute Book No. 3564);
- 4. Law No. 10/1995 on Customs Affairs (Statute Book 1995 No. 75, Supplement to Statute Book No. 3612).
DECIDES:
To stipulate :
THE PRESIDENTIAL DECREE ON THE IMPORT OF MERCHANT AND FISHING SHIPS IN NEW AND NOT NEW CONDITION.
Article 1
Referred to in this Presidential Decree as :
- 1. Merchant ships shall be ships or boats or other floating structures used to transport passengers and or goods;
- 2. Fishing ships shall be ships or boats or other floating structures used to catch fish, transport fish, including those for fish surveys or exploration.
- 3. Ships in used condition shall be ships ever operated in the other waters outside the customs area;
- 4. Import shall be activities to bring goods into the customs area.
Article 2
The companies importing merchant and fishing ships shall have freedom to import merchant and fishing ships in new and not new condition.
Article 3
The import of merchant and fishing ships in new and not new condition shall be carried out in accordance with the general provisions in the field of import stipulated by the Minister of Industry and Trade.
Article 4
With the enforcement of this Presidential Decree, all laws contravening this decree shall be declared null and void.
Article 5
This Presidential Decree shall come into force as from February 2, 1998.
